By way of a general background, Canada was not a signatory under the Hague Convention as it relates to the Apostille of documents. Under the Hague Convention, the signatories agreed to accept foreign documents provided that they proceeded through an internationally accepted method of authentication. This internationally accepted method was commonly referred to as “Apostille”. The affixing of the Apostille will help to ensure that the document in question issued by one signatory country will be deemed valid in the other signatory countries.
In Canada, because we were not signatories, any document that is intent upon being used abroad must proceed through the process of authentication and legalization. In simplistic terms, this means that a Canadian document must be stamped by the authentication section of Global Affairs Canada. Once done, the document is then stamped by the Embassy or Consular office for the country where one intends to use the document. The authentication and legalization process is relatively straightforward provided that one understands all of the bureaucratic requirements as defined by Global Affairs Canada and the diplomatic mission in question. Our office recommends that, in order to reduce potential delays and additional costs, one considers retaining an authentication and legalization service or process server to assist with this process.
