Terms: 

Capital Authentication is wholly owned by 7331339 Canada Inc. In this website, we may be referred to as ‘Capital Authentication’, ‘We’, ‘Us’, ‘Our’, or ‘Our Office’. The terms ‘Us,’ ‘We’, ‘Our’, ‘Our Office’, or ‘Our Website’, includes our owners, employees, agents.  For the purpose of this disclaimer, ‘CA’refers to Capital Authentication, and will be denoted as such in this document hereinafter.

You may be referred to as ‘You’ or, the ‘Client’. The terms ‘You’ or ‘Client’ includes you and any of your owners, employees, partners, independent contractors, subsidiaries, affiliates, attorneys, agents, heirs, and assigns. For the purpose of this disclaimer, you will be referred to as the ‘Client’hereinafter. The ‘Client’ refers to the party requesting services as offered from ‘CA’.

‘Documents’ refers to all materials supplied by the ‘Client’ to ‘CA’ for the purpose of authentication, authentication with legalization, legalization and/or visa processing. This includes, but is strictly not limited to, electronic and/or physical material, forms, passports, certificates, and any other supporting materials supplied to ‘CA’ by the ‘Client’.

‘Embassy / Consulate’ refers to the foreign office ‘CA’ will attend on behalf of the ‘Client’.

‘DFAIT’ refers to the Department of Foreign Affairs and International Trade, and for the purpose of this website, this term will also encompass the JLAC office, which is the specific section at DFAIT, responsible for authenticating Canadian documents for the purpose of use abroad.

‘MGS’ refers to the Ministry of Government Services, and is a Provincial Authority responsible for authenticating Canadian documents when an ‘Embassy/Consulate‘ enforces provisions that require documents to be authenticated at this office.

 

Disclaimer:

CA agrees to act as your agent for the sole purpose of authentication, authentication with legalization, or legalization of your documents that are intended to be used abroad in a foreign country.

CA agrees to act as your agent to assist in the procurement of visa documents in order for a specific individual to enter a foreign country wherein assistance from a third party service provider, such as CA, is allowed by the Embassy/Consulate.

The Client is fully responsible for ensuring their documents are complete, accurate, and in accordance with the current provisions as outlined by DFAIT, MGS, and/or the Embassy/Consulate. At no time will CA be neither responsible, nor liable for reviewing the accuracy and/or completeness of the contents of the Client’s documents.

As the onus lies upon the Client to ensure all DFAIT requirements are met, CA will not be held liable in the event that the Client is given misinformation, or out-dated and/or inaccurate information from DFAIT, or if this misinformation is acquired by the Client themselves.

As the onus lies upon the Client to ensure all Embassy/Consulate requirements are met, CA will not be held liable in the event that the Client is given misinformation, or out-dated and/or inaccurate information from the Embassy/Consulate, or if this misinformation is acquired by the Client themselves.

CA will not be held liable in the event that the Client is given misinformation, or out-dated and/or inaccurate information from any other third party source, or if this misinformation is acquired by the Client themselves.

CA assumes that all documents provided to us by the Client, is complete, accurate, and in accordance with the current provisions as outlined by DFAIT, MGS, and/or the Embassy/Consulate. CA will not be held responsible for incorrect, inaccurate, and/or incomplete documents supplied to us by the Client.

CA will not be held liable in any way, should a delay in service occur as a result of incorrect, inaccurate, and/or incomplete documents being supplied by the Client.

CA cannot be held liable in the event that DFAIT refuses to authenticate any particular document for any reason whatsoever. Furthermore, CA will not be held liable for any time delay(s) and/or additional costs associated with the Client having to provide any supplementary documents to CA, to be re-submitted to DFAIT for reconsideration.

CA cannot be held liable if an Embassy/Consulate either refuses entirely, or requests additional clarification and/or additional information in support of an application for a visa, or to legalize documents. Furthermore, CA will not be held liable for any time delay(s) and/or additional costs associated with the Client having to provide any supplementary documents to CA, to be re-submitted to the Embassy/Consulate for reconsideration.

As it is at the sole discretion of the Embassy/Consulate, or higher official, to grant a request for a visa to enter a county, CA cannot be held liable for the refusal of a request for a particular person(s) to enter any country in question.

Due to any unforeseen changes implemented by DFAIT and/or an Embassy/Consulate, the Client acknowledges that additional costs payable to either CA for their services rendered and/or to the Embassy/Consulate may apply.

CA cannot be held liable for any delay with the transit of documents back to Client, as caused by an independent courier/postal company.

In no event shall we be liable for any indirect, incidental, consequential, special, or exemplary damages or lost profits, even if we have been advised of the possibility of such damages, as a result of any delay(s) in service beyond our means of control.

 

Access:

CA is not liable for any unforeseen delays caused either directly or indirectly as a result of being denied access to the JLAC office at DFAIT, any MGS office, and/or any Embassy/Consulate. This includes, but is not limited to, buildings closures, protests, strikes, riots, bomb threats, building evacuations, capacity limitations, extreme weather conditions, holiday closures, or any other reason causing a delay and/or interruption to otherwise regular business.

 

Loss/Damage:

CA cannot be held liable for loss or damage to documents caused by any third parties and/or persons who are not direct employees of CA.

CA cannot be held liable for the loss or damage of passports, nor for the time and/or cost to replace a passport or the obtaining of a replacement visa which is caused by any third parties and/or persons who are not direct employees of CA.

CA does not assume any liability for lost or stolen documents, passports or visas that are caused by any third parties and/or persons who are not direct employees of CA.

Should a passport go missing for any reason, the RCMP may need to be advised in certain circumstances.
